Tennessee Senate Bills

Anatomical Gifts - As enacted, enacts the "Tennessee Genomic Security and End Organ Harvesting Act." - Amends TCA Title 56 and Title 68.

Real Property - As enacted, creates a legal process through which a person may request the immediate removal of an unlawful occupant of the person's commercial real property by filing a complaint with the sheriff for the county in which the property is located. - Amends TCA Title 29 and Title 66.

Health Care - As enacted, clarifies that an additional license for a collection station is not required, without regard to where specimens are transported, as long as the medical laboratory owner of the licensed medical laboratory retains ownership of the medical laboratory and oversight of the collection station. - Amends TCA Title 68, Chapter 29.

Real Property - As enacted, clarifies that property that is qualified as agricultural, forest land, or open space land, owned by two individuals, and held under the titles of tenancy by the entireties or of joint tenancy with right of survivorship, is deemed to have unchanged ownership upon the death of an owner if the property is retained by the other owner through a right of survivorship or upon the divorce of the owners if the property is retained by either owner through division and distribution of property in the divorce proceeding. - Amends TCA Title 11, Chapter 14, Part 2; Title 11, Chapter 15 and Title 67, Chapter 5.

Criminal Offenses - As enacted, expands the offense of organized retail crime to include certain acts, including knowingly using an online marketplace or social media platform to coordinate a meeting with one or more persons to sell, barter, or trade stolen merchandise for monetary or other gain; increases the punishment for the offense under certain circumstances. - Amends TCA Title 39, Chapter 14.

Criminal Offenses - As enacted, establishes mandatory minimum penalties of 48 hours in jail and a $500 fine for a person convicted of knowingly selling or distributing a product containing a hemp-derived cannabinoid to a person who is under 21; prohibits a retailer from knowingly allowing an employee younger than 21 to access, handle, or sell any product containing a hemp-derived cannabinoid on the premises of the retail establishment. - Amends TCA Title 39, Chapter 17; Title 43, Chapter 27 and Title 49, Chapter 6.

Education - As enacted, specifies that in an educational neglect case a subpoena may be issued for a student's attendance record, including all previous school years that the student attended a public school, in accordance with relevant privacy laws. - Amends TCA Title 37 and Title 49.

Emergency Communications Districts - As enacted, authorizes a motor vehicle operated by an emergency communications district that is marked as a mobile command vehicle or mobile communications vehicle to display flashing red or white lights or a combination of flashing red and white lights. - Amends TCA Title 55, Chapter 9, Part 4.

Children - As enacted, requires on or before June 30, 2026, and each June 30 thereafter, the council on children's mental health care to submit a report to certain officials regarding the status of the statewide system of care for children's mental health and the service delivery system and the status of children's mental health in this state. - Amends TCA Title 37, Chapter 3.

Workers Compensation - As enacted, increases, from 30 to 35, the minimum age for an individual to serve as a judge on the workers' compensation appeals board; increases, from two to three, the number of additional terms to which a judge of the workers' compensation appeals board may be reappointed; makes other changes related to workers' compensation. - Amends TCA Title 50, Chapter 6, Part 2.

Criminal Offenses - As enacted, creates the offense of intentionally impeding or obstructing a member of the division of protective services from ingress to, egress from, or movement about a location where the member is responsible for a person protected by the division of protective services; creates the offense of intentionally refusing to vacate an area where access has been restricted by a member of the division of protective services for the purpose of maintaining the safety or security of the person being protected. - Amends TCA Title 4 and Title 39.

Financial Responsibility Law - As enacted, requires the commissioner of revenue, instead of the commissioner of safety, to issue a certificate stating that a cash deposit or bond in the amount required by the Tennessee Financial Responsibility Law of 1977 has been paid or filed with the commissioner of revenue. - Amends TCA Section 55-12-139.

Railroads - As enacted, changes, from the governor to the commissioner of safety, the authority to whom a railroad company may apply to and who commissions an agent or employee as a railroad police officer. - Amends TCA Section 65-6-133.

Human Services, Dept. of - As enacted, makes various changes to the licensing exemption categories for programs and activities that fall within the definition of a child care agency; makes related changes, such as exempting home schools from licensure. - Amends TCA Title 4 and Title 71, Chapter 3, Part 5.

Welfare - As enacted, removes the requirement that a parent or caretaker enter a personal responsibility plan that requires a child to attend school and receive immunizations and health checks; removes certain requirements for a parent or caretaker regarding personal responsibility plans; removes a 20 percent reduction in temporary assistance payments for failure to comply with certain personal responsibility plan requirements. - Amends TCA Title 71.

Children - As enacted, removes the requirement that grants under the child care improvement pilot program be provided explicitly to nonprofit organizations in order to establish or make improvements to a child care agency. - Amends TCA Title 71.

State Employees - As enacted, requires the pay period for state employees be no less than twice per month as determined by the commissioner of finance and administration; removes the requirement that the pay period be semimonthly. - Amends TCA Title 8, Chapter 23, Part 2.

Adoption - As enacted, changes from 21 to 18 the age at which certain adoption records must be made available to certain adopted persons; makes various other changes regarding adoption records. - Amends TCA Title 36, Chapter 1, Part 1.

Real Property - As enacted, specifies certain persons who may submit electronic records for registration with a register of deeds that accepts electronic records under the Uniform Real Property Electronic Recording Act; makes other changes related to the act. - Amends TCA Title 47, Chapter 10, Part 1 and Title 66, Chapter 24, Part 2.

Insurance Companies, Agents, Brokers, Policies - As enacted, clarifies that the exemption from claims of creditors for the net amount payable under a policy of life insurance or under an annuity contract upon the life of a person made for the benefit of, or assigned to, the spouse, children, or dependent relatives of the person includes claims through execution, attachment, seizure, and garnishment, and that use of exempt funds does not change the classification of the funds used from exempt to nonexempt. - Amends TCA Title 56.

Economic and Community Development - As enacted, prohibits an employer seeking to receive an economic development incentive from the state from entering into a community benefits agreement or similar legal contract if the agreement or contract imposes obligations or conditions on the employer regarding employment practices, benefits, or operations that are not directly related to the performance of the employer’s duties under the economic development incentive. - Amends TCA Title 4.

Secretary of State - As enacted, establishes a complaint process with the secretary of state for any person who contends that the person’s name or address was included on a document filed with the secretary of state without the person’s consent. - Amends TCA Title 48.

Sunset Laws - As enacted, extends the transportation modernization board to June 30, 2029. - Amends TCA Title 4, Chapter 29 and Title 54, Chapter 3, Part 1.

Drugs, Prescription - As enacted, enacts the "Restore Trust in Public Health Messaging Act." - Amends TCA Title 53 and Title 68.

General Assembly, Confirmation of Appointment - Marsha Johnson, State Board of Education -

Education, Dept. of - As introduced, requires the department to compile an annual report on the number of students who complete the early graduation program to the education committee of the senate and the committee of the house of representatives having jurisdiction over kindergarten through grade 12 education by September 1 of each year. - Amends TCA Title 49.

Health Care - As introduced, authorizes a patient with a severe chronic disease or terminal illness to access, and a physician to recommend, investigational stem cell treatment; requires the commissioner of health to promulgate rules to, among other things, list the medical conditions that constitute a qualifying severe chronic disease or terminal illness. - Amends TCA Title 53; Title 63 and Title 68.

Traffic Safety - As introduced, requires the department of transportation to establish and administer a student pedestrian protection grant program; under certain conditions, authorizes grants to be awarded to local governments for designing, constructing, and repairing sidewalk infrastructure around public schools. - Amends TCA Title 4; Title 49; Title 54 and Title 55.

Infectious Diseases - As enacted, directs the commissioner of health to, on or before July 1, 2025, add alpha-gal syndrome to the department of health's published list of reportable diseases and conditions, the occurrence of which must be reported to the department by a healthcare provider pursuant to existing administrative rule. - Amends TCA Title 4; Title 63 and Title 68.

Sunset Laws - As enacted, extends the Bureau of TennCare within the department of finance and administration to June 30, 2029. - Amends TCA Title 4, Chapter 29 and Title 71.

Naming and Designating - As introduced, names the desk of house chamber seat number 60 as the “Legislative Desk of Representative John J. Deberry, Jr.”; directs the chief clerk of the house of representatives, or the chief clerk’s designee, to design and provide for the installation of a commemorative plaque on the side of the desk of house chamber seat number 60 to recognize the official name of such desk. - Amends TCA Title 3, Chapter 1 and Title 4, Chapter 8.

Sunset Laws - As enacted, extends the advisory committee for children's special services to June 30, 2029. - Amends TCA Title 4, Chapter 29 and Title 68, Chapter 12.

Game and Fish Laws - As enacted, extends the time within which the guardian for an adoptee who is less than 13 may apply for a lifetime sportsman license for adopted children from 36 months immediately following the adoption date to any time following the adoption that is prior to the adoptee's thirteenth birthday. - Amends TCA Title 70, Chapter 1, Part 5 and Section 70-2-201.

Traffic Safety - As enacted, authorizes a law enforcement officer to seize or impound a motor vehicle that is found with an installed license plate flipper; requires that the owner or operator of the motor vehicle, if present, be provided the opportunity to promptly remove the license plate flipper if it can be removed safely. - Amends TCA Title 38; Title 40 and Title 55, Chapter 10.

County Government - As introduced, requires the offices of sheriff, register, county clerk, assessor of property, and trustee in a county that has adopted a charter form of government to independently develop the budget for such office and submit the budget directly to the county legislative body; authorizes such offices to approve transfers between line items within the total amount of each category of personnel and operational maintenance; prohibits the county legislative body from implementing any kind of personnel restriction or operational maintenance restrictions on these offices. - Amends TCA Title 5.

Intellectual & Developmental Disabilities - As enacted, revises record retention requirements for records regarding services and supports received by persons with intellectual and developmental disabilities by the department of disability and aging's contracted providers and departmental facilities and clinics, updates outdated cross-references. - Amends TCA Title 4; Title 12; Title 33; Title 34; Title 36; Title 39; Title 49; Title 52; Title 68; Title 71 and Chapter 688 of the Public Acts of 2024.

Utilities, Utility Districts - As introduced, requires each utility system to obtain a certificate of analysis for any water sold by the utility system that contains fluoride, and post the certificate and the material safety data sheet for fluoride online. - Amends TCA Title 7, Chapter 36; Title 7, Chapter 82 and Title 68, Chapter 221.

Health Care - As enacted, enacts the "Individualized Investigational Treatment Act." - Amends TCA Title 53 and Title 63.

Public Health - As enacted, adds as a disease for which a laboratory must test during a standard serological test of a pregnant woman hepatitis C antibody (anti-HCV) with automatic reflex to HCV RNA if anti-HCV is reactive, and makes certain other changes to the process of conducting required pregnancy serological tests. - Amends TCA Section 68-5-602.

Municipal Government - As enacted, authorizes a certified municipal finance officer who is contracted with a municipality to provide financial oversight on behalf of the municipality to devote fewer than 16 hours per month to such duties, if the municipality seeks and receives written approval from the comptroller of the treasury. - Amends TCA Title 6, Chapter 56, Part 4.
