Local Government, General - As introduced, requires the attorney general and reporter, at the request of a member of the general assembly, to investigate an ordinance, regulation, order, or other official action adopted or taken by the chief executive officer or governing body of a political subdivision or any written policy, written rule, or written regulation adopted by any agency, department, or other entity of the political subdivision that the member alleges violates state law or the Constitution of Tennessee; creates penalties for violations. - Amends TCA Title 4; Title 8 and Title 67.

Environment and Conservation, Department of - As introduced, requires the department to submit an annual report regarding the number of applications filed pursuant to the Water Quality Control Act; requires the department to include information on the mechanism of compensatory mitigation provided for in permits that are required to have a provision for adequate compensatory mitigation; requires additional information when the mechanism of compensatory mitigation is an in-lieu fee program or mitigation banking. - Amends TCA Title 69.

Holidays and Days of Special Observance - As introduced, designates December 14 of each year as "Hazel Moore Day." - Amends TCA Title 3 and Title 4.

Notary Public - As introduced, adds that a person must complete a course of instruction and pass an examination to qualify to be commissioned as an online notary public; clarifies that an application to be commissioned as an online notary public requires a certification that the applicant has reviewed, understands, and will comply with the applicable rules and requirements promulgated by the secretary of state; adds that a course of instruction for online notarization must include, at a minimum, notarial laws, technology procedures of online notarizations, and ethical requirements for online notaries. - Amends TCA Title 8, Chapter 16, Part 3.

Secretary of State - As introduced, establishes a complaint process with the secretary of state for any person who contends that the person’s name or address was included on a document filed with the secretary of state without the person’s consent. - Amends TCA Title 48.

Secretary of State - As introduced, allows a litigation financier that is not a business entity or partnership to withdraw its registration with the secretary of state by filing a form prescribed by the secretary of state, along with a filing fee of $20. - Amends TCA Title 47, Chapter 16.

Tennessee Fish & Wildlife Commission - As introduced, directs the commission to promulgate rules to create and issue guide licenses for persons who work as guides at Reelfoot Lake. - Amends TCA Title 11, Chapter 14, Part 1 and Title 70.

Human Services, Dept. of - As introduced, requires the department, on a monthly basis, to analyze electronic benefit card data to identify food assistance recipients who have made purchases out of state for 90 consecutive days or more, send written notice to the identified recipients to request proof of in-state residency, and remove any recipients who fail to provide proof of Tennessee residency or fail to respond within 30 days; prohibits the department from granting a homelessness exception to work requirements unless the department has verified that the recipient is a homeless individual based on certain proof. - Amends TCA Title 71.

Local Government, General - As introduced, prohibits local governments from adopting or enforcing an ordinance, resolution, regulation, code, requirement, or policy that creates a program under which an individual is issued an unconditional cash payment on a regular basis to be used for any purpose by the individual. - Amends TCA Title 7, Chapter 51.

Bonding, Surety and Professional - As introduced, prohibits a person from acting as a professional bondsman, directly or indirectly, while owning, operating, or being employed by a qualified contract service provider that supervises persons who have been released prior to trial with conditions of release that include using an electronic monitoring device. - Amends TCA Title 40.

Flags - As introduced, prohibits state and local government entities from displaying or allowing display of flags other than Tennessee and U.S. flags on courthouses and public roads and sidewalks; prohibits LEAs and public charter schools from displaying in public schools flags other than the official United States flag and the official Tennessee state flag. - Amends TCA Title 4; Section 5-5-114; Section 6-54-144; Title 7; Section 15-2-116; Title 49; Title 55; Title 58 and Title 65, Chapter 31, Part 1.

Food and Food Products - As introduced, specifies that meat may be labeled as being free of mRNA vaccine if the animals from which the meat was derived were not administered an mRNA vaccine. - Amends TCA Title 44; Title 47, Chapter 18 and Title 53.

Local Education Agencies - As introduced, authorizes LEAs and public charter schools to employ retired law enforcement officers who are retired from a federal, state, or local law enforcement agency and honorably discharged veterans of the United States armed forces to serve as school resource officers on school premises; requires local boards of education and public charter school governing bodies to adopt policies to effectuate same. - Amends TCA Title 8; Title 10, Chapter 7, Part 5; Title 37; Title 38; Title 49; Section 55-8-151 and Title 62.

Criminal Offenses - As introduced, lessens, from 90 calendar days to 60 calendar days, the time within which a clerk of court must notify the health facilities commission of a conviction for certain offenses committed against elderly or vulnerable adults for inclusion on the registry of persons who have abused, neglected, misappropriated, or exploited the property of vulnerable individuals. - Amends TCA Title 39, Chapter 15.

Criminal Offenses - As introduced, creates a Class A misdemeanor for recklessly storing a firearm in a manner that a person knows or reasonably should know will allow a child younger than 18 years of age to access the firearm and the child brings the firearm to a school. - Amends TCA Title 39, Chapter 17, Part 13.

Juvenile Offenders - As introduced, requires a juvenile 16 years of age or older accused of a delinquent act to be transferred from juvenile court to criminal court to be tried as an adult if the juvenile has a prior adjudication of delinquency for any offense and the juvenile court finds probable cause to believe the juvenile committed the delinquent act. - Amends TCA Title 37; Title 39 and Chapter 1007 of the Public Acts of 2024.

Law Enforcement - As introduced, expands the notification and uniform requirements for peace officers who provide security or other duties outside of their primary jurisdiction to apply statewide rather than only in certain counties. - Amends TCA Title 62, Chapter 35.

Consumer Protection - As introduced, prohibits consumer reporting agencies from including on a consumer report a record of a medical debt judgment that is filed in this state. - Amends TCA Title 9, Chapter 8; Title 16; Title 18; Title 20; Title 21; Title 27; Title 28; Title 29; Title 45 and Title 47.

Criminal Offenses - As introduced, raises from $3,000 to $4,000, the maximum fine that a jury may impose for the offense of conveyance by general warranty deed with knowledge of existing liens. - Amends TCA Title 8; Title 39; Title 62 and Title 66.

TennCare - As introduced, requires a TennCare health benefit plan renewed or issued on or after July 1, 2025, by a health insurance carrier to provide coverage and reimbursement for biomarker testing for preeclampsia in pregnant women. - Amends TCA Title 56; Title 63; Title 68 and Title 71.

Highways, Roads and Bridges - As introduced, changes from January 1 to January 15 the date by which the department of transportation must submit its annual report on the status of projects funded by the transportation modernization fund. - Amends TCA Title 4; Title 54; Title 55; Title 65 and Title 67.

Traffic Safety - As introduced, authorizes the commissioner of revenue to take reasonable measures to publicize the availability of the option to designate in the Vehicle Title and Registration System (VTRS) database a driver's need for assistance with expressive language or communicating needs due to an intellectual or developmental disability or medical condition; authorizes the department of safety to take such measures with respect to the voluntary designation on a driver license or identification of an intellectual or developmental disability or medical condition. - Amends TCA Title 4; Title 5; Title 6; Title 7; Title 8; Title 54; Title 55; Title 65 and Title 67.

Medical Occupations - As introduced, deletes transitional language pertaining to the appointment and length of terms of members of the former board of medical examiners’ committee on physician assistants who were transferred to the new board of physician assistants in 2021, with the longest remaining term expiring in 2024; removes language limiting former committee members to a maximum of two consecutive four-year terms on the new board, inclusive of time as a member of the former committee. - Amends TCA Title 56 and Title 63.

Mobile Homes and Manufactured Buildings - As introduced, requires the department of transportation to submit a brief written summary to the committee of the house of representatives with jurisdiction over transportation matters and the transportation and safety committee of the senate no later than March 15, 2026, and March 15 of each subsequent year, concerning placards issued to transporters of manufactured homes pursuant to this section, including data on unsafe and erratic driving reported to the department using the telephone number that appears on the placards. - Amends TCA Title 55; Title 62; Title 67 and Title 68.

Pensions and Retirement Benefits - As introduced, clarifies that the notification provided by a retiree's new employer to the retirement system concerning the reemployment of the retiree as a law enforcement officer must be provided in writing. - Amends TCA Title 8.

TennCare - As introduced, directs the bureau to establish a temporary TennCare benefits program to provide medical assistance on a temporary basis to certain individuals who do not qualify for enrollment in TennCare, CoverKids, or a successor program; requires the bureau to submit a waiver to the federal centers for medicare and medicaid services by December 31, 2025. - Amends TCA Title 71, Chapter 5.

Taxes, Hotel Motel - As introduced, extends by 12 years the period in which Davidson County may charge an additional $0.50 privilege tax on the occupancy of a hotel room and in which such county may allocate the tax revenue for the purposes of direct promotion of tourism; extends by 12 years the terms of the committee members that oversee the fund in which the additional tax is deposited. - Amends TCA Section 7-4-202.

Election Laws - As introduced, provides a method for a nonrecognized minor party seeking recognition as a recognized minor party that notified the coordinator of elections that it seeks to nominate by primary election to rescind that notification; corrects a statutory reference. - Amends TCA Title 2.

Local Education Agencies - As introduced, requires each local board of education and governing body of a public charter school to display the Ten Commandments, the first sentence of the second paragraph of the preamble to the Declaration of Independence, and the preamble to the United States Constitution in a prominent location in each school building. - Amends TCA Title 49.

Safety - As introduced, decreases from 10 business days to 10 calendar days the amount of time the state fire marshal or another state agency, department, or entity must conduct a requested inspection for new construction or the renovation of an existing building. - Amends TCA Title 5; Title 7; Title 13; Title 68 and Title 69.

Food and Food Products - As introduced, excludes a cell-cultured food product from the definitions of meat and poultry for purposes of the Tennessee Meat and Poultry Inspection Act; prohibits local education agencies (LEAs), public charter schools, and public institutions of higher education from offering or distributing a cell-cultured food product through its school nutrition program, food service center, or another source through which the LEA, public charter school, or public institution of higher education provides food to students. - Amends TCA Title 40; Title 44; Title 47; Title 49 and Title 53.

Health Care - As introduced, requires the department of health to provide free diapers for new mothers and working parents of children less than two years old; requires LEAs and public charter schools to provide free feminine hygiene products in all women's and girl's bathrooms and locker rooms used by students in grades four through 12 in certain schools; requires public health campaigns dedicated to both purposes. - Amends TCA Title 49; Title 63; Title 67 and Title 68.

Local Education Agencies - As introduced, requires each local school board to establish a school lunch program and a school breakfast program that provide a free breakfast and lunch to each student enrolled in a school under the board's jurisdiction; requires the state to reimburse each LEA for the cost of providing a free breakfast and lunch to each student enrolled in the LEA after all available federal funds have been applied. - Amends TCA Title 49.

Public Officials - As introduced, creates a recall process for members of a municipal legislative body and of a city or county school board. - Amends TCA Title 2; Title 6; Title 7; Title 8 and Title 49.

Health, Dept. of - As introduced, requires hospitals that accept medicaid to inquire about a person's citizenship status and submit a quarterly report to the department on the number of hospital admissions and emergency department visits by persons lawfully and not lawfully present in the United States; requires the department to submit an annual report to the governor, speaker of the senate, and speaker of the house of representatives regarding the impact of uncompensated care for persons not lawfully present in the United States and other related information. - Amends TCA Title 33; Title 68 and Title 71.

Drugs, Prescription - As introduced, allows a student to possess and self-administer rescue seizure medication at school or at a school-related activity or event. - Amends TCA Title 49, Chapter 50, Part 16.

Energy - As introduced, establishes a regulatory framework for solar energy facilities in this state. - Amends TCA Title 5; Title 6; Title 7, Chapter 51 and Title 65, Chapter 17.

Taxes, Real Property - As introduced, requires half the revenue collected from recordation taxes be returned to the county in which the real property is located on a recurring basis; applies to transfers of real property on or after July 1, 2025. - Amends TCA Section 67-4-409.

Immigration - As introduced, requires a law enforcement agency in custody of an individual unlawfully present in the United States to request an immigration detainer and detain such individual for the maximum period as specified in the detainer; requires such agency to transport such individuals not taken into federal custody to a sanctuary city; requires department of revenue to request reimbursement for costs of detention and transportation of illegal aliens and to withhold federal petroleum taxes collected in this state if such reimbursement is not received. - Amends TCA Title 4; Title 7; Title 38; Title 39; Title 55 and Title 67.

Driver Licenses - As introduced, requires the department of safety to redesign driver licenses, instruction permits, intermediate driver licenses, and photo identification cards issued to lawful permanent residents of the United States, and temporary driver licenses and permits and temporary photo identification licenses issued to qualified noncitizens, so that the licenses and permits may be easily distinguished from driver and photo identification licenses issued to residents of this state who are United States citizens. - Amends TCA Title 55, Chapter 50.

Tourism - As introduced, requires a tourism development authority to file its annual audit and report with the members of the general assembly who represent the municipality that granted permission to the authority to organize; authorizes the audit and report to be filed electronically. - Amends TCA Title 7 and Title 67.

Abortion - As introduced, clarifies that the term "abortion," as defined for the offense of criminal abortion, does not include the use of contraceptives, including any device, medication, biological product, or procedure that is generally intended for use in the prevention of pregnancy, whether specifically intended to prevent pregnancy or for other health needs, or the disposal of embryos resulting from fertility treatments, including healthcare services, procedures, testing, medications, treatments, or products. - Amends TCA Title 37; Title 39; Title 63 and Title 68.

Criminal Offenses - As introduced, increases the penalty for civil rights intimidation from a Class D felony to a Class C felony if the victim of the offense was a minor or was selected by the defendant based on the victim’s status as a minister, preacher, pastor, priest, rabbi, or other spiritual leader of a religious belief who has been ordained or otherwise designated in conformity with the customs of a church, temple, or other religious group or organization. - Amends TCA Title 39.

Children - As introduced, clarifies that a child's parent, legal guardian, or legal custodian may access and review all health and medical records of the child, including those records related to treatments available to unemancipated minors without parental consent; allows an employee of a local education agency to provide bandages, gauze, or ice packs for the treatment of minor cuts, scrapes, bumps, and bruises. - Amends TCA Title 33; Title 36; Title 37; Title 49; Title 63 and Title 68.

Prisons and Reformatory Institutions - As introduced, specifies that the reimbursement of travel expenses incurred by members of the inmate disciplinary oversight board must be administered in accordance with the comprehensive travel regulations promulgated by the department of finance and administration and approved by the attorney general and reporter. - Amends TCA Title 4, Chapter 29 and Title 41.

Medical Occupations - As introduced, creates an exemption from the requirement that an applicant for licensure as a professional counselor must have completed a graduate course of study of at least 60 credit hours if the applicant has a valid, unencumbered license as a professional counselor issued by another state, territory, or federal district of the United States and the board for professional counselors, marital and family therapists and clinical pastoral therapists judges as acceptable the licensing requirements of that other state, territory, or federal district. - Amends TCA Title 63.
