Tort Liability and Reform - As introduced, establishes a cause of action through which a person who suffers injury, death, or property damage caused by the negligent action of an agent of the federal government engaged in an immigration enforcement action may file a suit against the federal agency to recover compensatory damages and reasonable attorney's fees and costs of bringing the action; requires the person to file a claim within one year of the cause of action accruing. - Amends TCA Title 28 and Title 29.

Sentencing - As introduced, increases from one year to three years the amount of time a defendant receiving a split sentence of confinement and probation may be required to serve a portion of the sentence in continuous confinement in the local jail or workhouse; specifies that the state is responsible for all costs of incarceration after the first year. - Amends TCA Title 40 and Title 41.

Comptroller, State - As introduced, requires the comptroller of the treasury to publish a copy of an audit conducted of the energy efficient schools council on the comptroller's website. - Amends TCA Title 49.

Professions and Occupations - As introduced, decreases from 30 to 21 days the time in which a licensed polygraph examiner or company must notify the commissioner of commerce and insurance of a change in business address. - Amends TCA Title 4; Title 62 and Title 63.

Business Organizations - As introduced, increases, from two to three, the number of days' notice that a for-profit corporation must give of the date, time, and place of a meeting to elect directors and complete the organization of the corporation or elect a board of directors to complete the organization of the corporation, if the initial directors are not named in the charter of the corporation. - Amends TCA Title 4; Title 29; Title 39; Title 46; Title 47; Title 48; Title 50; Title 61; Title 62 and Title 66.

School Vouchers - As introduced, changes the reporting date, from June 30 to June 15, by which each private school must provide the results of the tests that are required to be administered to recipients of an education freedom scholarship to the office of research and education accountability in the office of the comptroller of the treasury. - Amends TCA Title 49.

Courts, Administrative Office of the - As introduced, requires the administrative office of the courts to post the monthly reports on the number of personal injury or death cases filed claiming money damages, the number of such cases proceeding to trial, and the number of such cases resulting in damages on the website of the administrative office of the courts. - Amends TCA Title 8; Title 16; Title 17; Title 18; Title 20; Title 21; Title 24; Title 25; Title 26; Title 27; Title 28 and Title 29.

TennCare - As introduced, removes an obsolete reference to department of health beginning development of a demonstration project to provide cost effective alternatives to long-term care under the Omnibus Budget Reconciliation Act of 1981 on July 1, 1982. - Amends TCA Title 4; Title 7; Title 8; Title 12; Title 14; Title 33; Title 47; Title 52; Title 53; Title 56; Title 62; Title 63; Title 68 and Title 71.

TennCare - As introduced, increases from 60 to 65 days the period after the close of each fiscal year within which the department of finance and administration must submit a report to the governor and members of the general assembly that includes an account of the operations and expenditures of all funds under the Medical Assistance Act of 1968, statistics by county about all medical assistance within the state, rules promulgated to carry out the act, and other information the department deems advisable. - Amends TCA Title 4; Title 7; Title 8; Title 12; Title 14; Title 33; Title 47; Title 52; Title 53; Title 56; Title 62; Title 63; Title 68 and Title 71.

Taxes - As introduced, requires the commissioner of revenue to report to the general assembly on an annual basis, beginning July 1, 2027, the amount of sales and use tax refunds on purchases of major appliances, residential furniture, and residential building supplies issued to persons receiving federal disaster assistance. - Amends TCA Title 4; Title 9; Title 12; Title 54; Title 55 and Title 67.

Education, Higher - As introduced, deletes an obsolete requirement that the governing board of each public institution of higher education submit a report on the institution's implementation of a research security policy by July 1, 2025, to the chairs of the education committee of the senate and the education committees of the house of representatives. - Amends TCA Title 9 and Title 49.

Controlled Substances - As introduced, enacts the "Tennessee Kratom Consumer Protection Act." - Amends TCA Title 33; Title 39, Chapter 17, Part 4; Title 43 and Title 57.

Criminal Offenses - As introduced, adds insects to the offense of displaying, exhibiting, handling, or using a venomous or dangerous snake or reptile in a manner that endangers the life or health of another person. - Amends TCA Title 39.

Child Abuse - As introduced, adds the speaker of the senate and speaker of the house of representatives to whom the recipients of funding from the child abuse fund and its subsidiary funds, the child advocacy centers fund, the CASA fund, and the child abuse prevention fund shall report to annually regarding their use of child abuse fund moneys, their collaborative efforts to address the spectrum of child abuse issues, and their recommendations for additional improvements in the child abuse prevention and response system in this state. - Amends TCA Title 33 and Title 39.

TennCare - As introduced, removes an obsolete reference to July 1, 2000, as the initial date after which the department of health must ensure that application forms for TennCare uninsured or uninsurable coverage under the Medical Assistance Act apprise applicants of the requirements of the act. - Amends TCA Title 4; Title 7; Title 8; Title 12; Title 14; Title 33; Title 47; Title 52; Title 56; Title 62; Title 63; Title 68 and Title 71.

Taxes, Ad Valorem - As introduced, requires the notice submitted by the state board of equalization to a county mayor on whether an extension of time to complete a property reappraisal program is justified to be in writing. - Amends TCA Title 5; Title 6; Title 7; Title 9; Title 12 and Title 67.

Zoning - As introduced, removes requirement that a structure rebuilt on a site must conform to the zoning regulations existing at the time of the new construction. - Amends TCA Title 13, Chapter 7.

Criminal Procedure - As introduced, removes the requirement for a petitioner for restoration of citizenship or an applicant for a certificate of employability to pay the costs of the proceedings. - Amends TCA Title 40, Chapter 29.

Utilities, Utility Districts - As introduced, requires certain data centers to register with the Tennessee public utilities commission; requires electric and water utilities that provide service to registered data centers to report usage and rates to the commission; requires the commission's executive director to compile and publish certain information based on reports received from utilities. - Amends TCA Title 5; Title 6; Title 7; Title 10; Title 62; Title 65; Title 68 and Title 69.

Anatomical Gifts - As introduced, specifies that genome sequencing data may be stored within a foreign adversary or remotely accessed by a foreign adversary if the data is collected as part of a clinical trial or other biomedical research study conducted in accordance with federal rules. - Amends TCA Title 68, Chapter 30.

Local Government, General - As introduced, requires the attorney general and reporter, at the request of a member of the general assembly, to investigate an ordinance, regulation, order, or other official action adopted or taken by the chief executive officer or governing body of a political subdivision or any written policy, written rule, or written regulation adopted by any agency, department, or other entity of the political subdivision that the member alleges violates state law or the Constitution of Tennessee; creates penalties for violations. - Amends TCA Title 4; Title 8 and Title 67.

Environment and Conservation, Department of - As introduced, requires the department to submit an annual report regarding the number of applications filed pursuant to the Water Quality Control Act; requires the department to include information on the mechanism of compensatory mitigation provided for in permits that are required to have a provision for adequate compensatory mitigation; requires additional information when the mechanism of compensatory mitigation is an in-lieu fee program or mitigation banking. - Amends TCA Title 69.

Holidays and Days of Special Observance - As introduced, designates December 14 of each year as "Hazel Moore Day." - Amends TCA Title 3 and Title 4.

Notary Public - As introduced, adds that a person must complete a course of instruction and pass an examination to qualify to be commissioned as an online notary public; clarifies that an application to be commissioned as an online notary public requires a certification that the applicant has reviewed, understands, and will comply with the applicable rules and requirements promulgated by the secretary of state; adds that a course of instruction for online notarization must include, at a minimum, notarial laws, technology procedures of online notarizations, and ethical requirements for online notaries. - Amends TCA Title 8, Chapter 16, Part 3.

Secretary of State - As introduced, establishes a complaint process with the secretary of state for any person who contends that the person’s name or address was included on a document filed with the secretary of state without the person’s consent. - Amends TCA Title 48.

Secretary of State - As introduced, allows a litigation financier that is not a business entity or partnership to withdraw its registration with the secretary of state by filing a form prescribed by the secretary of state, along with a filing fee of $20. - Amends TCA Title 47, Chapter 16.

Tennessee Fish & Wildlife Commission - As introduced, directs the commission to promulgate rules to create and issue guide licenses for persons who work as guides at Reelfoot Lake. - Amends TCA Title 11, Chapter 14, Part 1 and Title 70.

Human Services, Dept. of - As introduced, requires the department, on a monthly basis, to analyze electronic benefit card data to identify food assistance recipients who have made purchases out of state for 90 consecutive days or more, send written notice to the identified recipients to request proof of in-state residency, and remove any recipients who fail to provide proof of Tennessee residency or fail to respond within 30 days; prohibits the department from granting a homelessness exception to work requirements unless the department has verified that the recipient is a homeless individual based on certain proof. - Amends TCA Title 71.

Local Government, General - As introduced, prohibits local governments from adopting or enforcing an ordinance, resolution, regulation, code, requirement, or policy that creates a program under which an individual is issued an unconditional cash payment on a regular basis to be used for any purpose by the individual. - Amends TCA Title 7, Chapter 51.

Contractors - As introduced, extends from two to four years the period of time that a contractor's certificate of license is valid before expiring and requiring renewal. - Amends TCA Title 62, Chapter 6.
