LOCOMOTIVES Act

This Act may be cited as the Lifting Overburdensome Commerce Obstructions and Motives Act or the LOCOMOTIVES Act.
Section 209(e)(1) of the Clean Air Act (42 U.S.C. 7543(e)(1)) is amended—
by striking either of the following new nonroad engines or nonroad vehicles subject to regulation under this Act— and inserting any of the following nonroad engines or nonroad vehicles:;
in subparagraph (A), by striking which are used in construction equipment or vehicles or used in farm equipment or vehicles and which are smaller than 175 horsepower. and inserting
, which are—
used in construction equipment or vehicles or used in farm equipment or vehicles;
smaller than 175 horsepower; and
subject to regulation under this Act.
in subparagraph (B), by inserting , which are subject to regulation under this Act after in locomotives; and
by adding at the end the following:
Locomotives or engines used in locomotives—
other than the locomotives and engines described in subparagraph (B); and
which are engaged in commerce, which shall encompass all locomotives engaged in providing common carrier railroad transportation for compensation pursuant to section 10102 of title 49, United States Code.
