Version IHSection 38 of the Arms Export Control Act (22 U.S.C. 2778) is amended—
in subsection (j)(1)(C)(ii)—
by striking subclauses (I), (II), and (III); and
redesignating subclauses (IV), (V), (VI), and (VII) as subclauses (I), (II), (III), and (IV), respectively; and
in subsection (l)(4)—
in subparagraph (B), by striking subsection (j)(1)(C)(ii) and inserting any of subclauses (I) through (IV) of subsection (j)(1)(C)(ii); and
in subparagraph (C)(ii), by adding at the end before the period the following: and does not relate to the Missile Technology Control Regime.
It shall no longer be the policy of the United States to apply a presumption of denial to exports of materials considered Category 1 or 2 of the Missile Technology Control Regime to North Atlantic Treaty Organization (NATO) allies, major non-NATO allies, or the other countries of the Five Eyes intelligence alliance.
In this section, the term Five Eyes intelligence alliance means Australia, Canada, New Zealand, the United Kingdom, and the United States.
